1.1 Welcome to BiuVibe. These Terms of Use (the "Terms") form a binding legal agreement between you and BiuVibe, governing your access to and use of our mobile application, website, and all related services, features, and content (collectively, the "Services").
1.2 By downloading, installing, accessing, registering for, or otherwise using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and all incorporated policies. If you do not agree to any provision of these Terms, you must refrain from any use of the Services and delete the application from your device. Your use of the Services constitutes your electronic acceptance of this agreement. We may update these Terms periodically, and your continued use after the effective date of any revisions will constitute your acceptance of the updated Terms.
You must be at least the minimum age required by the laws of your country or region to use the Services. If you are under the age of majority, you may use the Services only with the consent and supervision of a parent or legal guardian. By using BiuVibe, you represent and warrant that you meet these eligibility requirements.
3.1 You may be required to create an account to access certain features of the Services. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
3.2 You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You may not impersonate another person, create an account using false information, or transfer your account to another individual without our prior written permission.
3.3 If you believe your account has been compromised, you should notify us immediately. We reserve the right to suspend or terminate accounts that violate these Terms or pose a security risk.
4.1 You retain ownership of the content you create and upload to BiuVibe. However, by submitting content through the Services, you grant BiuVibe a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify, adapt, publish, distribute, publicly display, publicly perform, and otherwise use your content solely for the purpose of operating, improving, promoting, and providing the Services.
4.2 You represent and warrant that you own or have obtained all necessary rights, licenses, and permissions required to upload your content and grant the rights described in these Terms. You are solely responsible for the content you post and the consequences of publishing it.
5.1 To maintain a safe and respectful community, you agree not to engage in any of the following activities or behaviors when using the Services:
Uploading, publishing, transmitting, or otherwise making available any content that is illegal, defamatory, fraudulent, misleading, obscene, sexually explicit, hateful, discriminatory, violent, or otherwise objectionable under applicable law.
Infringing or violating the intellectual property rights, privacy rights, or other legal rights of any individual or entity.
Distributing malware, viruses, or any other harmful or malicious code.
Engaging in phishing, scams, fraud, or any other deceptive or manipulative activities.
Manipulating platform metrics, including artificially inflating views, likes, followers, or engagement.
Scraping, harvesting, or collecting user data or content without proper authorization.
Circumventing, disabling, or interfering with security features or access controls of the Services.
Reverse engineering, decompiling, or attempting to extract source code from the Services, except where expressly permitted by applicable law.
Using automated systems, bots, or scripts to access, interact with, or disrupt the normal operation of the platform.
5.2 Violation of any of the above rules may result in enforcement actions, including but not limited to removal of content, restriction of certain features, temporary suspension of your account, permanent termination of your account, and/or legal action where appropriate.
6.1 The Services, including but not limited to all underlying software, system architecture, user interface design, visual elements, brand assets, trademarks, service marks, logos, icons, graphics, text, audiovisual content, and any other materials or content made available by BiuVibe, are either owned by BiuVibe or licensed to us by third-party rights holders. These materials are protected under applicable intellectual property laws, including but not limited to copyright, trademark, and other proprietary rights laws in relevant jurisdictions.
6.2 Except where expressly authorized in these Terms or permitted by applicable law, you agree not to copy, reproduce, distribute, transmit, broadcast, display, perform, publish, license, sell, rent, modify, adapt, translate, reverse engineer, decompile, disassemble, create derivative works from, or otherwise exploit any part of the Services, whether in whole or in part, without obtaining our prior written consent. Any unauthorized use of the Services or its content may result in the termination of your access and may also constitute a violation of intellectual property laws.
7.1 BiuVibe is committed to protecting children and minors and has zero tolerance for any form of child sexual exploitation, abuse, or harm. We strictly prohibit any content, behavior, or activity that involves the sexual exploitation, abuse, endangerment, or inappropriate treatment of minors.
7.2 Users must not upload, share, create, distribute, request, promote, or otherwise make available any content that depicts, encourages, facilitates, or involves the sexual exploitation of children or minors, including but not limited to child sexual abuse material (CSAM), sexualized content involving minors, grooming activities, sexual solicitation, trafficking, or any attempt to exploit or harm a child.
7.3 We encourage users to report any content, behavior, or account that may involve the exploitation or abuse of minors. BiuVibe is committed to responding promptly to safety concerns and taking appropriate actions to protect children and maintain a safe online environment.
8.1 BiuVibe may offer certain paid features, virtual items, digital content, or other services that can be purchased through the App ("In-App Purchases"). By completing an In-App Purchase, you agree to pay all applicable fees and authorize the applicable payment provider or app store platform to process the transaction.
8.2 All In-App Purchases are intended for immediate use and access to digital content or services. Except where required by applicable law, platform policies, or expressly provided by BiuVibe, all purchases are final and non-refundable. Once a transaction has been completed, you generally cannot cancel the purchase or receive a refund.
8.3 Refund requests for purchases made through third-party platforms, including the Apple App Store or Google Play Store, must be submitted directly to the applicable platform in accordance with their refund procedures and policies. BiuVibe does not control and is not responsible for the refund decisions made by third-party payment platforms.
8.4 If a refund is required under applicable laws or approved by the relevant platform, any refunded digital content, virtual items, credits, subscriptions, or other purchased benefits may be removed, canceled, or adjusted accordingly.
8.5 You are responsible for reviewing all purchase details before completing a transaction, including pricing, subscription terms, renewal conditions, and the content or services included in the purchase. By confirming an In-App Purchase, you acknowledge and agree that you understand the nature of the digital goods or services being purchased.
The Services may include links to third-party websites, products, advertisements, or services. We do not own or control these third-party services and are not responsible for their content, privacy practices, or availability.Your use of third-party services is governed solely by the terms and privacy policies of the respective providers.
We are continuously improving BiuVibe to enhance performance, add new features, and improve user experience. As part of this process, we may update, modify, suspend, or discontinue certain parts of the Services, including features, functions, or content, at any time. Where required by applicable law, we will provide reasonable notice before making significant changes that may affect your use of the Services.
11.1 While we aim to keep the Services running smoothly and reliably, we cannot guarantee that BiuVibe will always be available without interruption. The Services may occasionally experience downtime, delays, technical issues, or security-related disruptions. We also do not guarantee that the Services will always be free from errors, bugs, or harmful components such as viruses or other malicious software, although we take reasonable steps to prevent and address such issues.
11.2 We make no representations or warranties regarding the accuracy, completeness, reliability, availability, security, or suitability of the Services or any content available through them.
To the maximum extent permitted by law, BiuVibe, its affiliates, officers, directors, employees, licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, revenue, goodwill, data, or business opportunities arising from or relating to your use of the Services.
You agree to defend, indemnify, and hold harmless BiuVibe, its affiliates, employees, officers, directors, licensors, and partners from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Services, your content, your violation of these Terms, or your infringement of any rights of another person.
14.1 We reserve the right, in our sole and reasonable discretion, to suspend, restrict, or permanently terminate your account or your access to the Services, in whole or in part, at any time without prior notice, if we have a good‑faith belief that you have breached these Terms, any incorporated policies, applicable laws or regulations. Such violations include, but are not limited to: posting prohibited content, engaging in harassment or abuse, impersonation, fraudulent activity, infringing intellectual property rights, or any conduct that threatens the security, integrity, or operation of the platform.
14.2 Upon suspension or termination, your access to your account, content, and related features will be immediately disabled. You may contact our support team to seek clarification or appeal a termination decision; however, we are not obliged to reinstate an account that has been terminated for cause. You remain responsible for any obligations incurred prior to termination, including pending transactions.
15.1 We may update these Terms from time to time to reflect changes in our Services, legal requirements, or business operations. Updated Terms will become effective upon publication unless otherwise specified.
15.2 Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the updated Terms.
